Denise P. Lubliner |Tampa, Florida Attorney at Law
I have represented injured employees who were wrongfully terminated from employment after filing a valid workers’ compensation claim. We simultaneously pursue her workers’ compensation claim and any wrongful discharge/workers’ compensation retaliation claims, if possible. The employer litigated hard on both claims, but after prevailing on the workers’ compensation hearing, we reached a favorable settlement for the global dispute.
I represent clients who need the tenacity and knowledge it takes when they are in need of a Tampa, Florida Whistleblower attorney and a non compete attorney who serves clients in Tampa, St. Pete as well as in Clearwater, Sarasota, Manatee and Pasco Counties. With the skill to draft, review or litigate legal matters with regards to non compete agreements and employment contracts, you can rest easy knowing I will do what it takes to protect your best interests. From wage and hour disputes, to discrimination and Florida Medical Leave Act lawsuits, Lubliner Law Firm stands firm for our clients and will fight for your rights.
Tampa Bay FMLA Retaliation Lawyer
I have represented an employers in a FMLA retaliation cases where the employer(s) have bent over backwards to help accommodate employee(s) even after he missed certification deadlines and the employee(s) tried to claim that this good deed by the employer entitled him to even more time to get his medical certification completed. This case came to me after the legal fees from a prior attorney became too much for the self-insured employer to bear. I ultimately settled the case for less than one month of the prior counsel’s bills.
Breach of Contract
I have represented several businesses and individuals where the matter in controversy was a breach of contract, either money owed or a breach of performance of work has occurred.
I represented employer(s) in a pregnancy discrimination act claim(s) where the employee’s restrictions for duty were expected to last more than seven (7) months and the restrictions were so substantial that the employee was unable to do most of her bona fide jobs duties. The case was resolved favorably for my client after merely taking the plaintiff’s deposition and one conference call with her attorney.
I have spent my career representing wronged employees and defending employers in suits brought by employees and former employees. My years as a corporate counsel have given me a unique perspective on corporate lingo and pretext. Additionally, I have a vast wealth of knowledge on the way companies store information and their internal document retention policies. This enables me to find evidence that others might not and has been beneficial in my career and as a Tampa Bay labor lawyer.
Other Areas of Practice
Represented several owners in the area of real estate litigation. These cases have ranged from landlord/tenant, ownership, leasing, land use, boundary disputes, homeowner or condominiums association disputes. I have represented clients in matters regarding construction defects, construction liens and indebtedness.
I like working on cases with good clients who find themselves in unfortunate situations. I often find that my clients are using a lawyer for the first time in their lives and I want to make the process of a lawsuit less daunting for them.
In addition, my firm has extensive litigation experience in the areas of real estate, landlord/tenant, foreclosure defense, construction, bankruptcy, creditor’s rights, homeowner association and condominium associations. I have been successful litigating cases against homeowner and condominium associations, real estate, landlord/tenant, contract disputes, collection of outstanding debt(s) and creditor’s rights.
Passionate, Tenacious, Knowledgeable.
I am passionate about what I do and have a tenacity that is unmatched. I have often heard from clients over the years that they’ve had prior attorneys that they never even met before their deposition. Every encounter with their law firm, from the initial consultation through the deposition preparation, had been handled by a legal assistant or paralegal. That will never be the case with me. I will be the person you tell your story to at the case’s inception and I will be the person you talk to about your case every step of the way.
